1. About these Terms
1.1 MathoKido is an AI-assisted mathematics tutoring service for students in Years 5 to 7 of the Australian Curriculum, available at mathokido.com and any associated web or mobile applications (the Service).
1.2 The Service is operated by Kevin Kuok Bing Tan trading as MathoKido (ABN 91 131 105 235) of 2 Wynette Avenue, Balwyn VIC 3103, Australia (we, us, our).
1.3 These Terms & Conditions (Terms) govern your access to and use of the Service. By creating an account, starting a subscription, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1.4 Our Privacy Policy forms part of these Terms and is incorporated by reference. Please read it before you sign up.
1.5 These Terms apply to individual and family subscriptions purchased by a parent, guardian, or a student aged 18 or over. We do not currently offer school, classroom or institutional subscriptions. If you are a school, teacher or education provider and wish to use MathoKido with your students, contact us at support@mathokido.com — separate written terms will apply.
2. Who can use MathoKido
2.1 To create an account and purchase a subscription, you must be at least 18 years old and have legal capacity to enter into a contract.
2.2 MathoKido is designed for children. A child may only use the Service through a child profile created and supervised by a parent or guardian who holds the account.
2.3 By creating a child profile, you confirm that:
- you are the parent or legal guardian of that child, or you have the parent's or guardian's permission to enrol them; and
- you consent to our collection, use and storage of that child's personal information in accordance with our Privacy Policy.
2.4 You are responsible for supervising your child's use of the Service, and for all activity that occurs under your account.
3. Accounts and account security
3.1 You must provide accurate information when creating your account and keep it up to date.
3.2 You are responsible for keeping your login credentials confidential and for any use of your account, whether or not authorised by you. Tell us immediately at support@mathokido.com if you suspect unauthorised access.
3.3 Your subscription is for personal, non-commercial, family use only. You must not share, sell, resell, lease or sublicense your account or access to the Service. Account access is for the nominated child profiles on your subscription.
4. Subscriptions, pricing and renewal
4.1 Plans. Subscription plans, inclusions and prices are shown at the point of purchase. All prices are in Australian dollars. We are a sole trader and are not currently registered for GST, so no GST is charged on our fees and prices shown are the total amount you pay. If we become registered for GST in the future (for example, if our turnover reaches the registration threshold), any GST that then applies will be handled as a change forced on us by tax law under clause 4.4(f) — we will give you notice, and you may cancel before it takes effect.
4.2 Auto-renewal. Subscriptions run for a minimum initial term of 1 month and automatically renew for consecutive terms of the same length unless you cancel before the end of the then-current term. We will charge your nominated payment method at the start of each renewal term.
4.3 Cancelling. You can cancel at any time from your account settings. Cancellation takes effect at the end of your current paid term. You keep access until then.
4.4 Your price is locked for up to 2 years.
- (a) The lock. We may change the prices we offer to new subscribers at any time. However, for a period of up to 2 years from the date your subscription starts (the Price Lock Period), a price increase will not apply to you while your subscription remains continuously active. You will keep renewing at the price you originally signed up at for the whole Price Lock Period.
- (b) Only pay more if you choose to. During the Price Lock Period, you will only ever pay a higher price if you choose to — that is, you expressly opt in to a new price, or you voluntarily upgrade or change to a different plan. We will never move you to a higher price during the Price Lock Period by default, by notice, or by continued use.
- (c) After the Price Lock Period. Once your 2-year Price Lock Period ends, standard pricing changes may apply to you on renewal. Before any increase takes effect, we will give you at least 30 days' notice by email, and you may cancel under clause 4.3 before it applies if you don't accept it.
- (d) Price reductions. If we reduce the price of your plan, we will pass the reduction on to you automatically at your next renewal.
- (e) Personal and non-transferable. Your locked price is personal to your account and is not transferable. If your subscription lapses or is cancelled and you later resubscribe, a new Price Lock Period starts at the price then current for new subscribers, unless we agree otherwise in writing.
- (f) Forced changes. If a change to your plan's price or inclusions is ever forced on us by law, tax or a third-party platform (for example, a change in GST or an app store's pricing rules), we will tell you at least 30 days beforehand and you may cancel under clause 4.3 without penalty.
4.5 Payment. Payments are processed by our third-party payment provider, Stripe. We do not store your full card details. Your use of the payment provider may be subject to their own terms.
4.6 Failed payments. If a payment fails, we may suspend access until payment succeeds, and may retry the charge. We'll contact you before suspending where practical. Note that if your subscription lapses because of a failed payment, clause 4.4(e) may affect your locked price — so please keep your payment details current.
4.7 App store purchases. If you subscribe through the Apple App Store or Google Play, billing and cancellation are managed by that store under its own rules, and you must cancel through your device account settings. We cannot cancel or refund those subscriptions on your behalf.
4.8 Your costs. You are responsible for your own device, internet access and data charges. It is your responsibility to ensure your device and connection meet the minimum requirements to run the Service.
5. Refunds and your consumer rights
5.1 Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies those guarantees. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the service remedied if it is not of acceptable quality and the failure does not amount to a major failure.
5.2 14-day free trial. New accounts include a 14-day free trial, so you can try MathoKido before you pay anything.
- (a) The trial runs for 14 days from the date you create your account and gives full access to the Service for your household. No payment details are required to start it, and we make no charge during it.
- (b) Because we do not collect card details to begin the trial, there is nothing to cancel if you decide not to continue — access to the paid features simply ends when the trial finishes, unless you choose to subscribe.
- (c) To keep using the Service after the trial, you subscribe at the price shown at the point of purchase (currently AUD 12.90 per month). The free trial is available once per household.
5.3 Cancelling a paid subscription. Once you have subscribed, you can cancel at any time under clause 4.3 and keep access until the end of the term you have paid for. We do not provide pro-rata refunds for cancelling part way through a paid term, except where required by the Australian Consumer Law or under clause 6.7.
6. Early access — the Service is under active development
Read this section carefully. MathoKido is a new and actively developing product. In exchange for early access — including a free trial and a low ongoing price — you accept that the Service is not yet finished. This section applies in addition to the rest of these Terms and, where there is any inconsistency, this section prevails.
6.1 The Service is under active development. You acknowledge and accept that MathoKido is at an early stage. In particular:
- (a) Content coverage is incomplete. Our question bank and lesson content are being built out progressively across the Australian Curriculum (ACARA v9.0) strands. Some topics, year levels and difficulty levels may be absent, thin, or under review at any given time. We note content additions and changes on our Release Notes page as content ships.
- (b) Content and structure will change. Questions, lessons, difficulty progressions, learning paths, and the way progress is measured may be revised, restructured, replaced or removed as we learn what works. Content your child has completed may be modified or retired.
- (c) Features will change. Features may be added, altered, or withdrawn without notice. A feature available today is not guaranteed to exist tomorrow. Features described as "beta", "preview" or "experimental" may be unstable or removed at any time.
- (d) Curriculum alignment is a work in progress. While we design content against the Australian Curriculum, we do not warrant that coverage is complete, current, or aligned to any particular school's scope and sequence. MathoKido is a supplementary tool, not a substitute for school instruction.
6.2 No availability or uptime commitment. The Service is provided on a best-efforts basis only. You acknowledge that:
- the Service is not guaranteed to be available 24 hours a day, 7 days a week;
- we do not offer a service level agreement, uptime target, or guaranteed support response time;
- we may take the Service offline for maintenance, updates or fixes at any time, with or without notice, including during school hours or peak study times;
- outages may occur due to our third-party providers (hosting, AI model providers, speech services, payment processors) and are outside our control; and
- we do not provide service credits or refunds for downtime, except as required by the Australian Consumer Law.
6.3 Errors are expected. You acknowledge that the Service may contain bugs, incorrect questions, incorrect answers or marking, incorrect AI tutoring responses, mis-graded progress, and other defects. See clause 7 for how the AI tutor works and its limitations. Please report problems to support@mathokido.com — that is exactly how MathoKido improves.
6.4 Data, progress and resets. We will take reasonable care with your data. However, during this early-access period you acknowledge that:
- progress history, scores, streaks, rewards and creature collections may be recalculated, migrated, reset or lost as we change the underlying data structures;
- we do not warrant that historical progress data will be preserved, exportable, or comparable over time; and
- progress data is provided for encouragement and guidance, not as a formal assessment of your child's ability, and must not be relied on as such.
6.5 Feedback. We may ask you for feedback, and may contact you about your experience. Participation is voluntary. Clause 12.4 explains what happens to feedback you give us.
6.6 What this section does not do. This section describes the state of the Service so that you can make an informed decision. It does not exclude, restrict or modify any guarantee, right or remedy you have under the Australian Consumer Law, and nothing in it should be read as attempting to. We are still required to supply the Service with due care and skill.
6.7 Your right to leave. You may cancel at any time under clause 4.3. In addition, if we make a change to the Service under clause 6.1 or 6.2 that materially reduces its value to you, you may cancel by contacting support@mathokido.com within 30 days of the change, and we will refund the unused portion of your current paid term on a pro-rata basis.
7. How the AI tutor works, and its limits
7.1 What it is. MathoKido uses artificial intelligence — including large language models supplied by third parties — to generate explanations, hints, step-by-step guidance, spoken responses and feedback in a Socratic tutoring style. Responses are generated at the time of use and are not pre-written or individually reviewed by a person before your child sees them.
7.2 AI can be wrong. AI-generated content may be inaccurate, incomplete, misleading, or pedagogically unhelpful, even when it sounds confident. It may explain a method your child's teacher does not use, or occasionally make arithmetic or reasoning errors. You and your child should not rely on the Service as the sole source of mathematical instruction, and should check anything important against your child's classroom materials or teacher.
7.3 Not a substitute for a teacher. The Service is a supplementary practice and tutoring aid. It is not a school, a tutor, an assessment authority, or a diagnostic tool. It does not provide educational, psychological, developmental or medical assessment or advice. If you have concerns about your child's learning, speak to their teacher or an appropriate professional.
7.4 Safety and moderation. We apply filters and prompt controls intended to keep the Service on-topic and age-appropriate. These are not perfect. If your child encounters content that is inappropriate, upsetting or off-topic, please stop use, report it to support@mathokido.com, and we will investigate.
7.5 Supervision. Because of clauses 7.2 and 7.4, we recommend that a parent or guardian remains reasonably aware of how their child is using the Service.
7.6 No automated decisions with significant effects. We do not use automated processing to make decisions about your child that produce legal effects or similarly significant effects on them. Difficulty adjustment, question selection and progress indicators are learning aids only.
7.7 Third-party AI providers. The Service passes your child's inputs (see clause 8) to third-party AI and speech providers to generate responses. Those providers process the data under their own terms and our agreements with them. Our Privacy Policy lists our current providers and where processing occurs, including any processing outside Australia.
8. Voice, audio and inputs
8.1 Some features may let your child speak to MathoKido or hear spoken responses. Where a feature uses the microphone, we will make that clear in the interface before it is used. Your child's speech is converted to text as they go, and we do not store an audio recording of your child's voice.
8.2 The text answers, working, chat messages, and the text converted from any spoken input your child provides (Inputs) are used to deliver the Service — to generate a response, mark work, and track progress.
8.3 Access to a child's stored Inputs is restricted to that child's profile and the parent or guardian who holds the account, behind the account login.
8.4 How long we keep Inputs, and how you can delete them, is set out in our Privacy Policy.
9. Privacy and children's data
9.1 We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, as described in our Privacy Policy.
9.2 We collect information about children only with the consent of a parent or guardian, given at the time the child profile is created.
9.3 We do not sell personal information. We do not serve third-party advertising to children in the Service, and we do not use children's personal information for advertising or profiling for marketing purposes.
9.4 Marketing communications are sent to the account holder only, never directly to a child, and only where you have opted in. You can unsubscribe at any time.
9.5 You may request access to, correction of, or deletion of your and your child's personal information by contacting support@mathokido.com. Our Privacy Policy explains how, our response timeframes, and how to complain to us or to the Office of the Australian Information Commissioner.
10. Acceptable use
10.1 You and your users must not:
- (a) use the Service for any commercial purpose, or to build, train, evaluate or benchmark any competing product or model;
- (b) use the Service for anything unlawful, or in breach of these Terms;
- (c) attempt to circumvent security features, rate limits, usage limits or paywalls, or gain unauthorised access to any account, system or data;
- (d) scrape, harvest, bulk-download or systematically extract questions, content, prompts or data from the Service;
- (e) reverse engineer the Service, or attempt to extract, discover or reconstruct our source code, prompts, model configurations or system instructions;
- (f) attempt to manipulate the AI into producing content outside the intended educational purpose of the Service;
- (g) upload or submit content that is unlawful, defamatory, abusive, obscene, offensive, infringing, confidential, or that contains malicious code;
- (h) submit false or fraudulent information, including fraudulent promotional codes; or
- (i) interfere with, disrupt or place an unreasonable load on the Service or its infrastructure.
10.2 We may remove content and suspend or terminate access where we reasonably believe this clause has been breached.
11. Our content and intellectual property
11.1 The Service and everything in it — including software, source code, prompts and prompt architecture, questions, question templates, lessons, explanations, worksheets, artwork, characters, creatures, audio, video, the MathoKido name and logo, and all other materials (our Content) — is owned by or licensed to us and is protected by copyright, trade mark and other intellectual property laws.
11.2 Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service and our Content for the personal educational use of the child profiles on your subscription, for the duration of your subscription.
11.3 Except as permitted by these Terms or by copyright law applicable to you (such as the Copyright Act 1968 (Cth)), you must not adapt, reproduce, communicate, store, distribute, print, publish, perform, display or create derivative works from any part of our Content, or commercialise anything obtained from the Service.
11.4 Printable resources we designate as printable may be printed and used for the personal, non-commercial use of the child profiles on your subscription. That's it — no distribution beyond your household.
11.5 Nothing in these Terms transfers any of our intellectual property to you.
12. Your content
12.1 You retain ownership of the Inputs and any other content you or your child submit (Your Content).
12.2 You grant us a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, reproduce, adapt, display and process Your Content for the purpose of:
- (a) providing and operating the Service for you and your child; and
- (b) maintaining, securing, troubleshooting, and improving the Service, including quality control and research — on an anonymised or aggregated basis only for this purpose (b).
12.3 This licence lasts as long as we hold Your Content, and ends when Your Content is deleted, except for anonymised or aggregated data that can no longer identify you or your child, and backups that are deleted on our ordinary backup cycle.
12.4 Feedback. If you send us suggestions, ideas, feature requests, bug reports or other feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it without restriction or obligation to you. This does not apply to any personal information in your feedback, which we handle under our Privacy Policy.
12.5 You are responsible for Your Content and confirm you have the right to submit it.
13. Third-party services and links
13.1 The Service relies on third-party providers, including our web hosting, AI model providers, speech / text-to-speech providers and our payment provider (Stripe). Their availability and performance are outside our control. Our Privacy Policy lists our current providers.
13.2 The Service may link to third-party websites or resources. We do not control them, do not endorse them, and are not responsible for their content, availability, or practices. You use them at your own risk and under their terms.
14. Changes to the Service
14.1 We may change, update, add to, suspend or discontinue any part of the Service at any time. Clause 6 sets out how this works and your right to leave.
14.2 If we discontinue the Service entirely, we will give you at least 30 days' notice by email and refund the unused portion of your current subscription term on a pro-rata basis.
15. Disclaimers and limitation of liability
15.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Clauses 15.2 to 15.4 apply only to the extent permitted by law.
15.2 Other than as set out in clause 15.1 and in any express warranty in these Terms, the Service and all content are provided "as is" and "as available", and we exclude all other warranties, conditions and representations, whether express or implied — including as to accuracy, reliability, availability, fitness for a particular purpose, or educational outcome. We do not warrant that the Service will improve any child's mathematical ability, results or NAPLAN performance.
15.3 To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or loss of data, profits, opportunity or goodwill, arising out of or in connection with the Service or these Terms, however caused.
15.4 Where our liability can be limited but not excluded, our total aggregate liability to you for all claims arising out of or in connection with the Service or these Terms is limited, at our election, to:
- (a) resupplying the Service or supplying an equivalent service; or
- (b) paying the cost of having the Service resupplied,
and in any event will not exceed the total fees you paid us in the 12 months before the claim arose.
15.5 We are not liable for any failure to perform caused by circumstances beyond our reasonable control.
16. Suspension and termination
16.1 You may cancel at any time under clause 4.3.
16.2 We may suspend or terminate your access if you breach these Terms, if payment fails, if we reasonably suspect fraud or misuse, or if required by law. Where the breach is not serious, we will give you notice and a reasonable chance to fix it first.
16.3 If we terminate your subscription without cause, we will refund the unused portion of your current term on a pro-rata basis.
16.4 On termination, your licence under clause 11.2 ends and access stops. Clauses 5, 11, 12, 15, 17 and 20 survive termination. We will handle your data in accordance with our Privacy Policy.
17. Indemnity
17.1 To the extent permitted by law, you indemnify us against loss, claims, damages and reasonable costs (including legal costs) arising from your breach of these Terms or your unlawful or negligent use of the Service, except to the extent caused by our own breach, negligence or wrongful act.
18. Changes to these Terms
18.1 We may update these Terms from time to time. We will post the updated version on this page with a new effective date.
18.2 If a change materially affects your rights, we will notify you by email at least 30 days before it takes effect. If you do not accept the change, you may cancel before the effective date and we will refund the unused portion of your current term on a pro-rata basis. Continuing to use the Service after the effective date means you accept the updated Terms.
18.3 For the avoidance of doubt, we cannot use this clause to raise your subscription price during your Price Lock Period. Clause 4.4 governs pricing and prevails over this clause.
19. General
19.1 Waiver. A failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
19.2 Severability. If any provision is found invalid or unenforceable, the rest continues in full force.
19.3 Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition or sale of assets, on notice to you. Any successor takes the Service subject to the locked pricing in clause 4.4.
19.4 Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
20. Governing law
20.1 These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts of appeal from them.

Email is our only contact channel. We aim to respond within a reasonable time. If you have a complaint we haven't resolved, you can contact the Australian Competition and Consumer Commission (consumer issues) or the Office of the Australian Information Commissioner (privacy issues).
